Tribunal rejects most claims in Bareilly–Sitapur highway dispute.
According to the National Highways Authority of India (NHAI), it has secured a favourable outcome in arbitration relating to the 151-km Bareilly–Sitapur BOT (Toll) project in Uttar Pradesh, undertaken by Bareilly Highways Project Limited (BHPL), a concessionaire promoted by Era Infra Engineering Limited. The project was terminated by NHAI in May 2019. NHAI said the three-member Arbitral Tribunal upheld the Supplementary Agreement dated March 30, 2015, concluded that project delays were concurrent and allowed three of the concessionaire’s 30 claims, awarding ₹46 crore plus applicable interest against total claims of around ₹3,177 crore.
NHAI stated that while the Tribunal did not allow its counterclaims relating to financial losses and public inconvenience, the Authority successfully defended against the majority of the concessionaire’s financial claims. The Authority also referred to recent arbitration outcomes involving the Tumkur–Chitradurga six-laning project in Karnataka, the Panipat–Jalandhar Highway project and the Kamrej–Chalthan section of NH-48 in Gujarat, which it said reflected its continued focus on contractual management and safeguarding public resources.
